This Privacy Policy (“Privacy Policy”) discloses the privacy practices for Neptune Group Yachting (NGY), affiliated companies and related websites (NGYI.com, NeptuneCrew.com, TheNeptuneGroup.com), hereafter referred to as “Companies” and “Websites”, and information collected by and from these Companies and Websites. This Privacy Policy applies to the practices of companies owned by Neptune Group Yachting and affiliated to it, including but not limited to those under direct management. We welcome you to our Websites; however, the terms of agreement are by visiting our Websites you agree to be bound by the terms and conditions of this Privacy Policy. If you do not agree, please do not use or access our Websites.

1. Information Collected

Our Companies’ Websites collect information from users at different points. Our primary goal in collecting information is to provide you, the user, with the best and most useful content and services.

Information collected includes:

(a) Personally Identifiable Information. This includes information that can directly identify an individual such as an individual’s name, mailing address, phone number or e-mail address. In order to contact us via our Websites, you may be directed to a link to a submission form that you may fill out to send us an e-mail. The Websites’ submission form, if any, may ask for Personally Identifiable Information so that we can communicate with you about your inquiry. Please note that this is not associated with any link to a third-party submission form that may relate to any advertisement, purchase or service inquiry you have about our Companies or related Websites.

(b) IP addresses. IP addresses are not linked to Personally Identifiable Information. For aggregate use, we may at times use IP addresses to analyze trends, administer the Websites, track users’ movements, and gather broad demographic information.

(c) Cookies and/or Web Beacons. Internet browsers have a feature called “cookies” that stores small amounts of data on a user’s computer hard drive containing information about that user. Web beacons, also called “web bugs,” “pixel tags” or “clear GIFs” may be used in combination with cookies. A Web beacon is typically a small graphic image on a Website that is also used to collect information about a user (not including your name, address, e-mail address or phone number). If a user rejects the cookie and/or modifies his or her browser settings to prevent / turn off cookies (which should also prevent Web beacons from tracking a user’s activities on the website), the user may still use our Website. The only drawback to this is that the user may be limited in some areas of our Website. (d) Third Party Advertisers. We use third-party companies to serve advertisements when you visit our Website or use our services. Third-party companies may also separately place or recognize a cookie file on your browser, use Web beacons or utilize similar technologies to collect information in the course of delivering advertisements. These companies may use information about your visits to this and other websites in order to provide advertisements about goods and services of interest to you.

(e) Information from Third Parties. In certain circumstances, in order for our Website to properly fulfill its obligation to our users, it is necessary for us to supplement the information we collect pursuant to this Privacy Policy with information from third party sources.

2. How Information Collected Is Used

We will not knowingly use information collected on this website in ways different from what is disclosed in the Privacy Policy that is currently in effect.

(a) Demographic Information. We will share aggregated demographic information with our partners and advertisers (e.g. third parties that present users with targeted advertising). The aggregated demographic information is not linked to any Personally Identifiable Information that can identify any individual person.

(b) Communicating with Our Users. We use Personally Identifiable Information (such as the user’s name, address, phone number or email address) to communicate with that specific user when he or she has customer service questions, concerns or comments about and/or for service announcements related to our Companies or related Websites. If a user contacts us, we may or may not delete the user’s emails or voicemails to us.

(c) Information Shared With Third Parties.

(i) We may partner with third parties who provide services to our users. When the user signs up for or agrees to receive a specific service provided by the third party, we share the information that is needed for the third party to provide the services.

(ii) We may share your Personally Identifiable Information with other entities that are owned by our affiliated Companies, or have some sort of corporate ownership relationship with our Companies.

(d) Addressing Legal Issues. We provide Personally Identifiable Information to respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims. We believe it is necessary to share Personally Identifiable Information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Companies’ policies, or as otherwise required by law.

(e) Sale or Transfer of our Companies. If all or a portion of any of our Companies is transferred, sold, merged, ceases operations, goes bankrupt, or is otherwise involved in a transaction where the ownership or management of our Companies is changed (individually or collectively, a “Transaction”), then your Personally Identifiable Information or other user information may be transferred or assigned to a third party as part of the Transaction.

3. Usage by Children under Age 13

Our Websites are not intended for use by anyone under the age of thirteen (13), and any individual under such age should not provide us with Personally Identifiable Information. We do not knowingly contact, market to, solicit, collect or use Personally Identifiable Information from or about any individual under the age of 13. It is possible that by fraud or deception we may receive information pertaining to children under the age of 13. If we are notified that we have personal information regarding a person under the age of 13, as soon as we reasonably verify the information, we will either obtain parental consent or otherwise delete the information from the account and/or service. 4. Communications from NGYI.com and Affiliated Websites.

If you have opted in to receive communication about our Companies through our Websites’ online submission form, you may occasionally receive marketing material on products and services provided by our Companies and related Websites.

5. Correcting/Updating Personal Information

Users must provide accurate and correct contact information (name, postal address, e-mail address, phone number) when using the submission form. If a user’s Personally Identifiable Information changes (such as a zip code), he or she may correct and/or update such information by sending us an e-mail request to info@NGYI.com.

6. Opting Out

Users are provided an opportunity to “opt-out” of having their information used for purposes not directly related to their inquiry. Users who no longer wish to receive certain marketing materials from our Companies may opt-out of receiving these communications by replying and typing “unsubscribe” in the subject line in the e-mail or by sending an e-mail request to info@NGYI.com. Furthermore, users that wish to restrict the usage of any non-Personally Identifiable Information provided by our aligned Companies to certain third-party members and may opt out of targeted advertising by following the instructions at: Info@NGYI.com.

7. Correspondence Destruction

If you decide to terminate any future correspondence with our Companies, all of your Personally Identifiable Information contained in your correspondence will remain on our servers. Upon receipt of a written request to remove personal data, we will retain some of your information in order to prevent fraud, collect fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce our other polices, address contractual issues, contact you for future marketing or promotional purposes, and comply with legal requirements. Therefore, you should not expect that all of your information to be completely removed from our databases in response to your requests.

8. Links to Third Party Websites

Our Websites contain links to other websites. Please be aware that we are not responsible for the privacy practices of such other websites. We encourage our users to be aware when they leave our website and to read the privacy policy of each and every website that may collect Personally Identifiable Information. This Privacy Policy applies solely to information collected by our Companies’ website.

9. Privacy Policy Changes

We reserve the right to periodically make changes to our Privacy Policy and use of information gathered. You are responsible for periodically checking our Privacy Policy.
